If this is happening right now

  • You have the right to ask for a lawyer. Say it clearly and calmly.
  • Do not sign or thumbprint anything you do not understand — ask for an interpreter.
  • Do not resist. Stay polite and comply, but you are not obliged to give a detailed statement before legal advice.
  • Remember the details — where you are held, the time, and officers' names, if you safely can.
  • Have someone message us your exact location in the airport and your flight — we act fast.

Why people are held at passport control

Officers don't always explain in detail. In practice, people are usually held for one of these reasons:

  • Waiting after a refusalHeld in the airside area pending the next return flight after entry was refused.
  • Document or identity checkOfficers are verifying your passport, visa or identity before deciding.
  • A database alertA name match or record has been flagged and needs to be resolved.
  • Status or stay questionA query over an overstay, a permit, or your right to remain.
  • Pending a decisionYou are kept while a decision on entry, removal or transfer is made.

Your rights if you are held

  • To be told, in general terms, why you are being held.
  • To ask for the assistance of a lawyer.
  • To an interpreter if you do not understand Turkish.
  • Not to be forced to sign or give a detailed statement you do not understand.
  • To have someone — a lawyer, your family, or your consulate — informed.
  • To humane conditions while you wait.

How far each applies depends on whether it is a short wait or formal administrative detention — which is exactly where early legal help matters.

Being held at the airport right now?You can ask for a lawyer — and you don't have to give a detailed statement first.

What to do — and what not to do

Do

  • Stay calm and polite
  • Ask clearly to contact a lawyer
  • Ask for an interpreter
  • Give basic identity details only, until you have advice
  • Note the place, time and officers if you safely can
  • Get someone to message us your location and flight

Don’t

  • Resist, push or raise your voice
  • Sign or thumbprint anything you don't understand
  • Give a long, detailed statement before legal advice
  • Hand over device passwords without asking why
  • Assume you cannot reach a lawyer — you can ask

How it usually unfolds

  • Stopped & questionedYou are taken aside at passport control for questioning.
  • Held to waitYou wait in a holding area while officers check and decide.
  • DecisionYou are admitted, returned on a flight, or — in some cases — placed under formal administrative detention.
  • If detained furtherFormal administrative detention follows its own rules; depending on the case there may be steps to challenge it.

The first hour often shapes what follows — reaching a lawyer early gives you the most options.

At which airport — IST or Sabiha Gökçen?

We act at both Istanbul airports, around the clock:

IST SAW
  • Istanbul Airport (IST)The large hub on the European side, where most holding at the border happens.
  • Sabiha Gökçen (SAW)The airport on the Asian side — smaller, but the same rules and rights apply, and we cover it too.

Frequently asked questions

How long can I be held at the airport?

It depends on the legal basis. A short wait for checks is common; formal administrative detention has its own rules and limits. If you are being held, contact us so we can act on the correct footing.

Can I really ask for a lawyer from the airport?

Yes — you can ask to contact a lawyer. If you are prevented or unsure, have someone outside reach us on your behalf with your details.

Can you reach me if I am held airside?

We can often communicate with the relevant desk and, depending on the case, attend in person. Give us your exact location and flight as early as possible.

Should I give a statement before I get advice?

In many cases it is wiser to wait. Stay polite, give basic identity information, and ask to speak to a lawyer before any detailed statement.

Can my family contact you on my behalf?

Yes. If you cannot reach us yourself, a family member or friend can message us your name, location in the airport and flight, and we will act.

Is this the same as being arrested?

No. This page is about administrative holding at the border. If you are held over a warrant, a criminal allegation or an INTERPOL notice, tell us — that is handled differently.

Will I be moved to a removal centre?

In some cases people are transferred pending removal; in many they simply wait airside and are returned. It depends on the facts — contact us so we can check.

Is my conversation with you confidential?

Yes. What you share with us is protected by attorney–client confidentiality under Turkish law.
