Residence permit problems

Residence permit (ikamet izni) refused, cancelled, or a renewal that has stalled — and now your status feels uncertain? These are administrative decisions you can often question. Speak with a licensed İstanbul Bar attorney before a deadline passes.

If this is happening right now

  • Get a copy of the written decision. Ask for the decision and the reason in writing.
  • Note the date you were notified. Any objection or appeal deadline usually runs from that date.
  • Do not let your status simply lapse. Acting within the window protects more options than waiting.
  • Keep every document — passport, current/old permit, application receipts and correspondence.
  • Do not sign anything you do not understand — ask for an interpreter.
  • Contact us before the deadline — by WhatsApp, with the decision and your dates.

What a residence permit is — and what can go wrong

A residence permit (ikamet izni) is official permission to stay in Türkiye for longer than a visa allows. There are different types — short-term, family, student and others — each with its own conditions, all under the Law on Foreigners and International Protection (Law No. 6458, “YUKK”).

Three things commonly go wrong: an application is refused, an existing permit is cancelled, or a renewal stalls or is rejected. Each is an administrative decision — and administrative decisions can usually be questioned through the proper route.

Why a permit is refused or cancelled

The reason is not always spelled out clearly. In practice, refusals and cancellations usually trace back to one of these:

  • Incomplete or inconsistent applicationMissing documents, errors, or details that don’t match the records.
  • Funds or insuranceDoubts about sufficient means or required health insurance.
  • Address / registrationProblems with your declared address or registration.
  • A prior overstay or violationAn earlier breach can affect a new permit. See our visa & overstay page.
  • Conditions no longer metFor example a student permit when studies end, or a family permit when circumstances change.
  • Public-order groundsA refusal or cancellation said to be on public-order or security grounds.

If your renewal is delayed or your permit lapsed

A common worry is a renewal that is still pending when the old permit expires. Whether you keep a lawful status in that gap depends on the rules and on having a valid application on file. If a permit has genuinely lapsed, the situation can shade into an overstay — which is why timing matters.

If you are already past expiry, do not assume the worst or simply keep waiting. Tell us your dates and we will tell you honestly where you stand.

Your rights

  • To be notified of the decision and, in general terms, its reason.
  • To ask for an interpreter if you do not understand Turkish.
  • Not to sign a document you do not understand.
  • To ask to speak to a lawyer.
  • To object or appeal within the applicable time limit.

What to do — and what not to do

Do

  • Get the written decision and its reason
  • Note the date you were notified
  • Keep your permit, passport and receipts
  • Act within the appeal deadline
  • Resolve any address or insurance gap
  • Get advice before you stop trying to stay legal

Don’t

  • Let your status lapse without advice
  • Assume a refusal automatically means removal
  • Miss the objection deadline
  • Sign documents you do not understand
  • Submit a fresh application without understanding why the last failed
  • Wait until the last day to seek help

The process & timeline

  • Decision & notificationThe refusal or cancellation is issued and notified to you; the deadline clock usually starts here.
  • Objection / appealWithin the time limit, the decision can be challenged where there are grounds.
  • Decision on the challengeThe authority or court decides; the permit may be granted, restored, or the refusal upheld.
  • Next stepsDepending on the outcome, we advise on re-applying, regularising your stay, or what a refusal means for staying or leaving.

Deadlines run from notification and can be short — acting early is far more effective than reacting late.

Situations we see

A few situations we see often — yours may differ, but the approach is the same:

  • Renewal stuck near expiryA renewal still pending as the old permit runs out, leaving status uncertain.
  • Refused on funds or insuranceAn application turned down over means or health-cover requirements.
  • Cancelled after an overstayA permit cancelled following an earlier breach, raising both status and ban questions.
  • Family permit after a changeA family-based permit questioned after a change in circumstances.

Who we help

  • Foreign residents refused or cancelled
  • People whose renewal has stalled near expiry
  • Students moving to work or family status
  • Families on family-based permits
  • People with a past overstay seeking to regularise
  • Employers and sponsors acting for staff

Frequently asked questions

Can I appeal a residence permit refusal in Türkiye?

Often yes — a refusal or cancellation usually carries an objection or appeal route within a deadline that runs from notification. The forum and time limit depend on the decision. Get advice quickly.

How long do I have to challenge the decision?

The deadline is usually short and runs from the date you were notified, so that date matters. Tell us when you received the decision and we will act on the right timeline.

Can I stay in Türkiye while my renewal is pending?

It depends on whether you have a valid renewal application on file and its status. Tell us your dates and we will check where you actually stand.

My permit was refused over funds — is that final?

Not necessarily. Refusals on means or insurance can sometimes be addressed or challenged, depending on the facts and what was actually required. We assess this case by case.

Does a refused permit mean I will be deported?

Not automatically. A refusal can leave you without status, which is serious, but it is a separate step from a removal decision. We explain what it means for you and act on any deadline. See our deportation page.

My permit was cancelled after an overstay — what now?

Cancellation after an overstay can raise both status and entry-ban questions. We look at the whole picture — the cancellation, any fine, and any ban — and the realistic options.

Can you help if I am already abroad?

Often yes. Tell us what happened and where you are; in many cases a power of attorney lets us act for you in Türkiye.

Do you speak my language?

We assist in English and Turkish, and can arrange interpretation in other languages. Tell us what you are most comfortable in.

How much does it cost?

The first message to understand your situation carries no obligation. If you decide to engage us, we explain the fee clearly and agree it before any work begins.
