Deportation & removal

Given a removal decision (sınır dışı), told you will be deported, or held in a removal centre? A deportation decision can sometimes be challenged — and timing is critical. Speak with a licensed İstanbul Bar attorney before any deadline passes.

If this is happening right now

  • Stay calm and ask for the written decision. Ask for a copy of the removal decision and the reason.
  • Note the date you were notified. Any appeal deadline usually runs from that date.
  • Ask for a lawyer and an interpreter. You do not have to face this in a language you don’t fully understand.
  • Do not sign anything you do not understand — especially a document that may waive an appeal or accept “voluntary” departure.
  • Keep every document — passport, the decision, and any paper you are handed. Photograph them.
  • Contact us before the deadline — by WhatsApp, with the decision and your dates.

What deportation (sınır dışı) means

A deportation or removal decision (sınır dışı etme) is a formal decision that you must leave Türkiye. It is an administrative decision under the Law on Foreigners and International Protection (Law No. 6458, “YUKK”), usually issued by the immigration authorities.

This is different from being refused at the border on arrival — for that, see our denied entry & deportation page. Removal here concerns someone who is already in the country (or was admitted) and is now ordered to leave. While removal is arranged, a person may be held — see administrative detention at the airport.

Why a removal decision is issued

Officers don’t always set out the full reason. In practice, removal decisions usually trace back to one of these — the exact basis must be checked:

  • Overstay / visa violationStaying beyond your permitted time or breaching visa conditions. See our visa & overstay page.
  • An entry ban or recordA tahdit or other record flagged against you.
  • Public order / security groundsRemoval said to be on public-order, security or similar grounds.
  • Working without permissionEmployment without the required work permit.
  • A criminal matterRemoval connected to a criminal process or conviction.
  • Status or residence problemA residence-permit refusal, cancellation or lapse leaving you without status.

Your rights

  • To be notified of the decision and, in general terms, its basis.
  • To ask to speak to a lawyer.
  • To an interpreter if you do not understand Turkish.
  • To appeal or object within the applicable time limit.
  • To contact your embassy or consulate in appropriate cases.
  • To humane treatment while any removal is arranged.

How these apply in practice depends on the facts and your status.

What to do — and what not to do

Do

  • Get a copy of the written decision
  • Note the exact date you were notified
  • Ask for a lawyer and an interpreter
  • Keep your passport and all documents
  • Act within the appeal deadline
  • Tell us immediately if someone is being held

Don’t

  • Sign a document you do not understand
  • Accept “voluntary” departure without advice if you want to appeal
  • Miss the appeal deadline
  • Assume removal cannot be challenged
  • Throw away the decision or any paper
  • Wait until the last moment to seek help

The process & timeline

  • Decision issued & servedA removal decision is made and notified to you; the deadline clock usually starts here.
  • Possible detentionYou may be held in a removal centre while removal is arranged.
  • Appeal windowWithin the deadline, the decision can be challenged where there are grounds.
  • OutcomeRemoval proceeds, or the decision is suspended or overturned where the challenge succeeds.

Removal deadlines are short and run from notification — acting immediately is far more effective than waiting.

A facility where people may be held while removal is arranged.
Administrative detention (idari gözetim)
Being held under immigration rules — not a criminal arrest. More on detention →

Frequently asked questions

What is the difference between denied entry and deportation?

Denied entry is a refusal at the border when you arrive. Deportation (sınır dışı) is a formal decision to remove someone who is already in the country or was admitted. They follow different procedures, though both can carry an entry ban.

Can I appeal a deportation decision in Türkiye?

Often yes — there is usually a route to challenge a removal decision within a strict deadline that runs from notification, and in some cases an appeal can pause the removal. Get advice immediately.

How long do I have to challenge a removal?

The deadline is short and runs from when you are notified, so the date you received the decision matters. Tell us that date and we will act on the right timeline.

Will I be detained while I am being deported?

You may be held in a removal centre (geri gönderme merkezi) under administrative detention while removal is arranged. It is an immigration measure with its own review. If someone is being held, tell us at once.

Can I come back after being deported from Türkiye?

It depends on whether an entry ban was recorded, its type and duration, and the facts. Some bans can be challenged or lifted; others must be waited out. Check your status before you book.

Is deportation a criminal punishment?

Removal is generally an administrative measure under immigration law, not a criminal sentence — though a criminal matter can sometimes be connected to it. We tell you which applies in your case.

Should I accept ‘voluntary’ departure?

It can affect your appeal rights and any ban, so do not agree to it just to end the wait. Get advice first — especially if you want to challenge the decision.

Can you help if a family member is in a removal centre?

Often yes. Tell us who and where, and what they were told. We can advise on both the detention and the removal, and act where there are grounds.

Do you speak my language?

We assist in English and Turkish, and can arrange interpretation in other languages. Tell us what you are most comfortable in.

How much does it cost?

The first message to understand your situation carries no obligation. If you decide to engage us, we explain the fee clearly and agree it before any work begins.
