If this is happening right now

  • Stay calm and polite. Cooperate with the security and identity checks — you are being processed, not judged.
  • You have the right to remain silent. You do not have to explain how the item got there before a lawyer is present.
  • Say clearly: “I want a lawyer.” Ask for an interpreter if you are not comfortable in Turkish.
  • Do not sign your statement (ifade) or any form you do not fully understand. A surrender or seizure form can carry legal weight.

  • Do not argue, joke about weapons, or try to leave. Asserting your rights calmly is what protects you.

What does it mean if a prohibited item is found in your bag?

It means an item that is not allowed through security — or not allowed in Türkiye at all — has turned up in your checked or cabin baggage, usually at the X-ray and security line or at customs. The honest answer to "how serious is this?" is: it depends on the item, the quantity and the circumstances. Two very different things can happen.

Administrative handling. For many ordinary travel items — a small knife, a multi-tool, pepper spray, certain liquids — a common outcome is that the item is taken from you (surrendered or seized) and you continue. No one is accused of a crime. This is closer to a confiscation than a prosecution.

A criminal matter. Other items can turn a security stop into a criminal investigation. A firearm or ammunition found in baggage is the clearest example, governed by Law No. 6136 on firearms and knives. Certain blades, stun devices, and some replica or imitation weapons can also raise issues under that law or under the Turkish Penal Code (TCK, Law No. 5237). When that line is crossed, you may be taken to the airport police, and the matter is then handled under the Code of Criminal Procedure (CMK, Law No. 5271).

Crucially: not realising something was prohibited is very common, especially for travellers and dual nationals carrying items that are perfectly legal at home. That does not by itself decide how the case is treated — but it is exactly the kind of fact a lawyer can help present properly. Which items most often cause a problem?

These are situations seen at IST and SAW. What is legal at home may be restricted or illegal here:

  • A firearm or ammunitionA gun, parts, or even a few loose rounds found in checked or cabin baggage is the most serious category — handled under Law No. 6136.
  • Knives and bladesFolding knives, hunting knives, multi-tools and some larger blades can be restricted; the response ranges from surrender to a criminal stop.
  • Pepper spray and self-defence spraysSprays that are sold freely in some countries are restricted here and are commonly taken at security.
  • Stun devices and tasersElectroshock self-defence devices can fall under firearm-and-weapons rules rather than being treated as ordinary gadgets.
  • Replica and imitation weaponsToy, blank-firing, airsoft or souvenir weapons can be treated seriously depending on how realistic or convertible they are.
  • Other items legal at homeSome tools, hunting gear or collectables are restricted in Türkiye and only surface at the X-ray or at customs.

What are your rights if this becomes a criminal stop?

If you are taken to the airport police, the same core protections apply as in any criminal matter in Türkiye:

  • To remain silent — you do not have to explain anything.
  • To a lawyer, and to have one present for your statement (ifade).
  • To an interpreter if you do not understand Turkish during official proceedings.
  • To be told what you are suspected of.
  • To notify a relative, and where relevant your consulate, that you are held.
  • To medical attention if you need it.

There are legal limits on how long you may be held in police custody (gözaltı) before you are brought before a prosecutor or a judge, and there are rules on how items must be seized and recorded. The exact limits depend on the situation, which is why getting a lawyer in early matters. A note on language: we give spoken advice in English and Turkish, and written communication can be in your own language; if you need spoken help in another language, an interpreter or notary can be arranged at your cost. That is separate from your right to a state interpreter during official proceedings, which stands on its own.

  • Speculate about who packed the bag or why
  • Joke, argue, or downplay a weapon to officers
  • Offer or hint at any payment to make it go away
  • Assume it is automatically “just a confiscation” and explain it away

How does the airport process usually unfold?

  • Detection at the lineThe item is spotted at the X-ray or security screening, or at customs on arrival or departure.
  • Initial assessmentOfficers decide whether this is an administrative matter (item taken) or a possible offence.
  • Surrender or seizureIf administrative, the item is surrendered or seized and recorded — read what you sign.
  • Referral to airport policeIf it is treated as criminal, you are taken to the airport police unit and the criminal procedure begins.
  • Statement (ifade)You may be asked to give a statement — this is where having a lawyer present matters most.
  • Prosecutor and judgeThe public prosecutor decides the next step; a judge may become involved depending on the matter.

These stages can move quickly. The most useful step is getting a lawyer involved before you give any statement — once it is recorded, it is much harder to revisit.

I didn't know the item was prohibited in Türkiye — does that help me?

Not realising an item is restricted here is very common, especially for travellers and dual nationals. Do I have to give a statement to the airport police?

What about pepper spray, a stun gun, or a replica weapon?

These are restricted in Türkiye even though some are sold freely elsewhere. Pepper spray and knives are often taken at security; stun devices and realistic replicas can be treated more seriously, sometimes under weapons rules. The handling depends on the device and the situation, so get advice on your specific item.

Can a lawyer come to the airport while this is happening?
