How Long Can They Hold You at Istanbul Airport?

Held at passport control or in a holding room at Istanbul Airport (IST/SAW)? How long they can keep you depends on the legal basis — here is what to know and do.

If you or someone you know is being held at Istanbul Airport (IST) or Sabiha Gökçen (SAW), the honest answer to "how long?" is: it depends on the legal basis. Simply waiting airside for a return flight is different from being placed under formal detention — and they follow different rules. What stays constant is that you keep your rights the whole time, and that the early hours are often when a lawyer can do the most.

This article is general information about Turkish law and procedure, not legal advice. Time limits and rules change and every case turns on its own facts. Do not rely on it for your situation — speak with a lawyer.

The short answer

There is no fixed number of hours that applies to everyone. Two very different situations get called "being held":

  • Waiting airside for the next available flight after a refusal — often hours, sometimes overnight.
  • Formal administrative detention (idari gözetim) under immigration rules — a distinct measure with its own time limits and reviews.

Which one you are in decides how long it can last and what can be done.

Waiting airside vs. formal detention

If you are refused entry, you are usually taken to a holding area in the international (airside) zone while the airline and authorities arrange your return. You have not legally entered Türkiye, and you are typically returned on the next available flight. This waiting can be long, but it is not the same as being formally detained. Our guide on denied entry at Istanbul Airport covers that situation.

By contrast, if you are formally held under immigration rules, that is administrative detention — a measure that must follow set procedures.

What is administrative detention (idari gözetim)?

Administrative detention (idari gözetim) is being held under immigration law — for example pending removal — not a criminal arrest. It is governed by the Law on Foreigners and International Protection (Law No. 6458, "YUKK") and is subject to rules on duration and review. People may be held in a removal centre (geri gönderme merkezi) during this period. Our detention at the airport page explains how we act in these cases.

How long can administrative detention last?

Administrative detention is not open-ended — it is time-limited and subject to periodic review, with the details depending on the situation. We will not state a specific number of days or weeks that may be wrong or out of date; the limit and review points should be confirmed for the actual case.

What matters in practice is that there are rules and review points — which is exactly where a lawyer can check that the limits are respected and act where they are not.

Your rights while you are held

Whether you are waiting airside or formally detained, in general terms you may:

  • Ask the reason you are being held.
  • Ask for an interpreter if you do not understand Turkish.
  • Ask to speak to a lawyer.
  • Decline to sign documents you do not understand.
  • Contact your embassy or consulate in appropriate cases.
  • Be treated humanely while you wait.

How these apply depends on the facts and whether the situation is a simple wait or formal detention.

What to do if you are being held

A few calm steps protect your options. Stay polite and do not sign anything you do not understand. Ask, clearly, for the reason and for a lawyer. Keep your documents together and note the time things happen. Above all, make contact early — the wait is often the only window to act before a return flight leaves. If a family member is held, find out where they are and on what basis, and get advice quickly.

How can a lawyer help?

A lawyer who knows the airport context can establish whether you are simply waiting or formally detained, check that any detention follows its time limits and reviews, communicate with the relevant authorities, arrange interpretation, and — where there are grounds — challenge the basis for holding you or for any removal. We never promise an outcome; we tell you honestly what can be done. Guidance can usually begin within minutes by phone or WhatsApp.

Frequently asked questions

How long can they legally hold you at the airport?

It depends on the basis. Waiting airside for a return flight can be hours or overnight; formal administrative detention is time-limited with periodic reviews. There is no single figure — we check what applies to the specific situation.

Is waiting in the holding area the same as being detained?

No. Waiting airside for a return flight is common and is not formal detention. Administrative detention (idari gözetim) is a separate immigration measure with its own rules. They are treated differently.

What is administrative detention (idari gözetim)?

It is being held under immigration law — for example pending removal — rather than a criminal arrest. It is governed by Law No. 6458 (YUKK) and is subject to time limits and review.

Can I be held overnight at Istanbul Airport?

Yes, it can happen — for example when the next return flight is hours away. You can still ask for the reason, an interpreter and a lawyer while you wait.

Do I have the right to a lawyer while held?

You can ask to speak to a lawyer, and getting advice early often matters most, because the wait may be the only window to act before a return flight. Tell us your terminal and situation.

What should I do if a family member is being held?

Find out where they are and on what basis, make sure they know to ask for a lawyer and not to sign what they do not understand, and get legal help quickly. The first hours often shape what happens next.

Being held is frightening, but it is bounded by rules — and the wait is often the very window in which a lawyer can act.
