Arriving at Istanbul Airport (IST) or Sabiha Gökçen Airport (SAW) and being intercepted by border passport police due to an INTERPOL Red Notice (Kırmızı Bülten), Diffusion Notice, or bilateral extradition request is an immediate legal emergency.

Under Turkish criminal law and the Law on International Judicial Cooperation in Criminal Matters (Law No. 6706), border apprehension triggers a multi-stage judicial proceeding involving the Airport Police, the Chief Public Prosecutor’s Office, the Ministry of Justice, and the Duty High Criminal Court (Ağır Ceza Mahkemesi).

Without immediate, aggressive criminal defense intervention at the initial interrogation stage, travelers risk being remanded into pre-extradition prison custody for up to 40 days while foreign states assemble formal extradition dossiers.

1. Statutory Grounds for INTERPOL Detention at Istanbul Airport

Under Article 14 of Law No. 6706 and the European Convention on Extradition (ECE):

  1. Border Detection & Immediate Holding: The passport control system flags the traveler's passport number against the INTERPOL General Secretariat database. The passenger is transferred to the Airport Police Holding Facility (Havalimanı Emniyet Şube Müdürlüğü).
  2. Prosecutor Notification (Within 24 Hours): The border police notify the Gaziosmanpaşa or Anadolu Duty Chief Public Prosecutor.
  3. Provisional Arrest (Geçici Tutuklama - Law 6706 Art. 14): The prosecutor refers the individual to the competent Duty Criminal Peace Judgeship (Sulh Ceza Hakimliği) to decide on provisional arrest. Under international treaties, provisional detention cannot exceed 40 days pending the receipt of formal extradition paperwork from the requesting country.

2. Statutory Bars to Extradition Under Turkish Law (Law No. 6706 Art. 11)

Turkish courts will REFUSE extradition under Article 11 of Law No. 6706 if any of the following statutory bars apply:

  • Political or Military Offenses: If the offense is deemed political, military, or motivated by political dissent, extradition is strictly prohibited.
  • Risk of Torture or Inhuman Treatment (ECHR Art. 3): If substantial grounds exist to believe the individual will face torture, ill-treatment, or unfair trial in the requesting state.
  • Capital Punishment / Life Imprisonment Without Parole: If the offense carries the death penalty without formal diplomatic assurances.
  • Turkish Citizenship: Turkish citizens cannot be extradited to foreign nations (except before the International Criminal Court).
  • Statute of Limitations / Amnesty: If the prosecution has lapsed under Turkish or requesting state limitation periods.

3. High Criminal Court Extradition Trial (İade Yargılaması)

Once the requesting country submits the formal extradition dossier via diplomatic channels, the High Criminal Court (Ağır Ceza Mahkemesi) conducts a formal extradition hearing:

  • The court examines the admissibility of evidence, dual criminality (çifte suçluluk), and human rights risks.
  • The defense lawyer files petitions demonstrating human rights violations, political persecution, or procedural defects in the Red Notice.
  • If the High Criminal Court rules that extradition is inadmissible, the individual is released immediately from detention.
